Week 4: Copyright Infringement

Read Chapters 12 and 13.

Discussion Topics:

  • What is the difference between plagiarism and copyright infringement?
  • Are the following copyright infringements?  Why or why not?
    • Example 1:  You reprint the entire text of Martin Luther King Jr.’s famous “I Have A Dream” speech on “parchment” paper in a form suitable for framing for your alma mater, a small and struggling but well regarded liberal arts college, which sells the printed speeches for ten dollars each to raise money for a new library.  Is this infringement?
    • Example 2:   On the cover of your corporation’s annual report, you use a photo of a small segment of a Wall Street Journal article that contains a 25-word quotation naming your corporation as an innovator in its field.  Is this infringement?
  • Do the “Paraphrasing Self Test” on page 12/8 – Compare your answers and thoughts with what the courts decided on page 12/9.
  • What are the defenses to copyright infringement?
  • What are the ways the Burne Convention protects copyrights?
  • What countries belong to the Burne Convention?
  • What is the second most important international copyright treaty?
  • How does GATT apply to copyrights?
  • What does the WIPO Treaty cover?
  • Which countries provide NO protection for U.S. Author’s work?
  • What foreign works are NOT entitled to U.S. Copyright protection?
